End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User", "Player") and Infinite Retry Studio ("Company", "we", "us") governing your access to and use of Endless TD ("Game").

By installing, accessing, or playing the Game, you agree to be bound by this Agreement. If you do not agree, do not use the Game.

1. Eligibility

You must be at least 13 years of age, or the minimum legal age required in your jurisdiction, to use the Game.

If you are under the age of majority, you represent that a parent or legal guardian has reviewed and agreed to this Agreement on your behalf.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Endless TD for personal, non-commercial entertainment purposes only.

You do not own the Game. All rights not expressly granted are reserved by Infinite Retry Studio.

You may not:

• Resell, rent, lease, or sublicense the Game
• Host unauthorized servers or services
• Use the Game for commercial exploitation without permission

3. Early Access Disclaimer

Endless TD is an Early Access game.

You acknowledge that:

• The Game is not complete and is actively under development
• Features, systems, and content may change at any time
• Bugs, crashes, or data loss may occur
• Online services may be modified or discontinued
• Save data or progress may be reset
• No guarantees are made regarding future updates or features

4. Online Features & Accounts

Some features require:

• Internet connection
• Game account
• Platform account (e.g., Steam)

Game accounts may be automatically created and linked to platform identifiers.

You are responsible for:

• Account security
• All activity under your account

We may suspend or terminate access at our discretion.

5. Acceptable Use

You agree not to:

• Cheat, exploit, reverse engineer, or modify the Game
• Use bots, automation, hacks, or unauthorized software
• Disrupt servers or player experiences
• Harass or abuse other players
• Circumvent security or enforcement systems
• Buy/sell accounts or items for real money

Violations may result in bans without notice or refund.

6. User Conduct & Content

You are solely responsible for your communications and behavior.

We may moderate, remove, restrict, or report content at our discretion.

We are not responsible for user-generated content.

7. Virtual Items & Purchases

Virtual Items:

• Have no real-world monetary value
• Are licensed, not owned
• Are non-transferable and non-refundable (except as required by law)
• May be modified or removed at any time

Purchases are governed by third-party platform terms.

7.1 Nature of Virtual Items

Virtual Items are digital, licensed content.

Certain Virtual Items, including but not limited to icons, banners, cosmetic visuals, and interface elements, may be created using human-authored design and AI-assisted tools.

Your purchase or acquisition of Virtual Items:

• Does not transfer ownership of any digital files
• Does not grant intellectual property rights
• Grants only a limited, revocable license for in-game use

Virtual Items may not be extracted, reproduced, or used outside the Game.

8. No Ownership of Data or Progress

Gameplay data, rankings, and items:

• Are not guaranteed to persist
• May be modified, reset, or removed
• Do not create property rights

9. Intellectual Property

9.1 Ownership and Asset Creation

The Game includes human-authored software, design, and assets, as well as assets created or enhanced using AI-assisted tools.

Regardless of the method of creation, all Game content — including selection, coordination, arrangement, presentation, branding, trademarks, logos, visual identity, and overall expression — remains the exclusive property of the Company or its licensors.

No rights are granted except as expressly provided.

9.2 Restrictions on Asset Use and Extraction

You may not, without express written permission:

• Extract, scrape, or copy Game assets
• Reproduce or distribute Game content
• Use Game assets for commercial purposes
• Use Game assets for AI or ML model training
• Create derivative works based on Game assets

These restrictions apply regardless of copyright status.

Unauthorized use constitutes a breach of this Agreement.

10. Anti-Cheat & Security Measures

The Game may employ anti-cheat, fraud detection, and security technologies.

You acknowledge that:

• Monitoring tools may analyze gameplay behavior
• Automated systems may detect violations
• Enforcement actions may occur without prior notice

Attempts to interfere with these systems are prohibited.

11. Telemetry & Technical Data

The Game may collect technical and gameplay-related data necessary for:

• Game functionality
• Performance optimization
• Security and fraud prevention
• Service improvements

Collection and use of data are governed by our Privacy Policy.

By using the Game, you consent to such data processing.

12. Payments, Fraud & Chargebacks

All purchases are final except as required by law or platform policies.

You agree not to:

• Initiate fraudulent chargebacks
• Abuse refund mechanisms
• Use unauthorized payment methods

We reserve the right to:

• Suspend accounts associated with payment disputes
• Revoke Virtual Items obtained through chargebacks
• Recover losses resulting from fraudulent activity

13. DLC & Future Content

The Game may offer additional paid or free content, including:

• Downloadable content (DLC)
• Expansions
• Virtual Items
• Services or subscriptions

Such content is governed by this Agreement unless otherwise stated.

We reserve the right to modify, discontinue, or rebalance content.

14. Website & Related Services

Your use of related websites, online services, and community platforms operated by the Company is governed by applicable Terms of Service and Privacy Policies.

In the event of conflict, this Agreement governs Game usage.

15. Termination

We may suspend or terminate this Agreement at any time.

Upon termination:

• Your license ends immediately
• Accounts/data may be deleted
• No refunds are owed

Sections relating to intellectual property, disclaimers, liability limits, and dispute resolution survive termination.

16. Disclaimers

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE".

To the maximum extent permitted by law:

• We disclaim all warranties
• We do not guarantee uninterrupted service
• We are not responsible for data loss or service interruptions

17. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect or consequential damages
• We are not liable for loss of progress or Virtual Items
• Total liability shall not exceed amounts paid in the prior 12 months

18. Indemnification

You agree to indemnify Infinite Retry Studio from claims arising from:

• Your use of the Game
• Violations of this Agreement
• Your conduct or content

19. Governing Law & Disputes

This Agreement is governed by the laws of the State of Missouri, without regard to conflict of law principles.

Disputes shall be resolved through:

• Good faith negotiation
• Binding arbitration under applicable rules
• Or small claims court where permitted

You waive participation in class actions.

20. Severability

Invalid provisions do not affect the remainder of the Agreement.

21. Changes to This Agreement

We may update this Agreement at any time.

Continued use constitutes acceptance.

This Agreement and the Privacy Policy constitute the entire agreement governing Game usage.

By installing, accessing, or playing Endless TD, you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement.
